A court hearing took place on 11th September focusing on Messer’s access to the Crude Helium Enrichment Unit (CHEU), which is opposed by Air Products (AP). The CHEU is a crucial component of the Federal Helium System, which is owned by Cliffside Refiners, L.P. or CRLP (equally owned by Linde, AP and Messer). Messer sought a temporary injunction to maintain access to the CHEU to ensure uninterrupted operations and successfully ensured a 2-month mediation period with a continuation of the Temporary Restraining Order (TRO), allowing Messer to continue to utilise the helium plant. The judge asked for a report on the mediation's result by 20th October. If the parties failed to reach an agreement, the litigation would be stayed for an additional 90 days. During this stay, the temporary injunction (allowing MHC to continue operating the CHEU) will remain in place.
